Privacy Policy | Yacht Hire Marbella
Last updated:
This page explains what happens to your personal data when you visit yachthiremarbella.com, send us an enquiry, message us on WhatsApp, or book a charter with Yacht Hire Marbella. It is written for anyone browsing our yachts, requesting a quote, or sailing with us, and it sets out your rights under Regulation (EU) 2016/679 and Spanish Organic Law 3/2018.
If anything here is unclear, write to us at [email protected] and we will explain it in plain terms, not legal jargon.

1. Who looks after your information
Yacht Hire Marbella, the brand operating the website yachthiremarbella.com from Marbella, decides how and why your personal data is used in connection with this site and our charter bookings. For any privacy question, correction, or request, write to [email protected]. That is also the address to use for all booking enquiries, so one message reaches the right people.
2. What we collect and where it comes from
We gather information in a few straightforward ways:
- Enquiry form – your name, your email address, and, if you choose to share them, a phone number, the yacht you're interested in, your proposed charter dates, the number of guests, and whatever you write in the message box. The form also quietly passes along the page you were on and the site that sent you there, which helps us understand which part of the website led to the enquiry.
- Email, phone and WhatsApp – whatever you tell us directly when you get in touch, plus, if you tap a WhatsApp button on the site, a record of that click (the page, the referring site, the language of the page, and the prefilled message) stored in our booking system before WhatsApp opens.
- Server logs – standard technical entries (IP address, time, page requested, browser) generated automatically by the hosting that serves our website, kept briefly for security purposes.
- Visit statistics – our own measurement script, served from our own domain, records things like pages viewed, time spent, the site that referred you, campaign tags in the link, device type, browser, operating system, screen size, browser language, and a country worked out from your IP address; we do not store the IP address itself. If you then send an enquiry or tap a WhatsApp or phone link, that action is linked to the same visit so we know which channel brought you to us.
3. Why we use it, and on what legal basis
We process your data so that we can reply to your enquiry, prepare a written quote, and, if you go ahead, confirm and run your charter — these are pre-contractual steps and then contractual necessity once a booking is agreed. For example, if you're after a day built around swim stops, water toys and a beach club call rather than a fixed sunset loop, we use the details you give us about guest numbers and preferences to check tender and toy setup against the right boat, such as the Benetti Oasis 40 or the Riva 130 Bellissima, before you ever step aboard.
We also rely on our legitimate interest in keeping the website and our systems secure and working properly, which covers server logs and visit statistics. Where a booking is confirmed, certain data must be processed to meet legal obligations tied to chartering — including, where applicable, providing guest names to port authorities. We never use your data for automated decision-making, and we don't send marketing emails unless you specifically ask us to.
4. Who we share it with
Access to your data is limited to what each party actually needs:
- Our own team, who handle enquiries and bookings, including through an internal messaging tool used to pass your enquiry along quickly so someone can respond.
- The captain or skipper who will run your charter once a booking is confirmed, since they need guest numbers and relevant details to prepare the boat and the day properly.
- The hosting provider that serves our static website and keeps the underlying server logs.
- Google Fonts and the jsDelivr content delivery network, which load the typefaces and the phone-number formatting tool used on our enquiry form; loading these resources means Google and jsDelivr receive the visitor's IP address as part of normal internet delivery, though neither sets cookies on our behalf.
- WhatsApp, operated by Meta, if you choose to start a conversation with us there. Once you're inside WhatsApp, that conversation is governed by WhatsApp's own privacy policy, not this one.
We do not sell personal data to anyone, and we don't pass it to third parties for their own marketing.
5. Guest names for the crew list
Once a charter is confirmed, Spanish port and maritime authorities typically require a crew list naming everyone on board. If you book with us, we will ask for the full names of your guests so the captain can prepare this list, as required for the vessel to sail legally out of Marbella. This information is used solely for that purpose and shared only with the captain and, where legally required, the relevant port authority.
6. Where your data is processed
Our booking records and website are handled within the ordinary course of running a Marbella-based charter business, and we do not routinely send your data outside the European Economic Area. Where a service we rely on, such as a content delivery network, operates internationally as part of how the internet works, that transfer happens only to the extent needed to load the resource and is not something we control directly.
7. How long we keep it
If your enquiry doesn't turn into a booking, we delete it after 12 months. If it does become a confirmed charter, we keep the associated records for as long as Spanish tax and accounting rules require us to, since those records support invoicing and our legal reporting obligations. Server logs kept for security are retained only briefly. Local browser storage used for site preferences expires or is cleared as described below, and we never store your contact details in it.
8. Browser storage and measurement
Our site doesn't set cookies of its own. It does use a small amount of browser storage:
- A local-storage entry that remembers you've closed the cookie notice.
- A session-storage entry that remembers which yacht you clicked on, so the enquiry form can be prefilled for you; it disappears when you close the tab or send the form.
- A local-storage entry holding random, non-identifying visitor and session codes used for our own visit statistics; it expires 30 days after your last visit and you can clear it in your browser at any time.
None of these entries contain your name, email, or phone number.
9. Keeping your information secure
We limit access to enquiry and booking data to the people who need it to do their job, and server logs are kept only briefly and used for security monitoring. No method of storing or transmitting data online is completely risk-free, but we aim to use reasonable, proportionate safeguards given the type of information involved, which is mostly contact and booking detail rather than sensitive categories of data.
10. Your rights
Under Regulation (EU) 2016/679 and Organic Law 3/2018, you can ask us to:
- Confirm what personal data we hold about you and give you a copy of it.
- Correct anything that's inaccurate or incomplete.
- Delete your data, where we're not required to keep it for legal or accounting reasons.
- Restrict or object to certain processing, including anything based on our legitimate interest.
- Receive your data in a portable format, where that applies.
To exercise any of these, email [email protected]. We'll respond within one month and may ask for some proof of identity first, simply to make sure we're not handing your data to the wrong person. If you feel we haven't handled your data properly, you can also lodge a complaint with the Agencia Española de Protección de Datos at www.aepd.es.
11. Children, and updates to this policy
Our charters and this website are intended for adults making their own booking decisions, and we don't knowingly collect data from children through the site. If we ever become aware that a child's data has reached us without appropriate consent, we will delete it.
We may update this policy if our practices, the services we use, or the law change. The version published on yachthiremarbella.com is always the current one, and we encourage you to check back if you have any doubts before sending us your details.
