Terms and Conditions – Yacht Hire Marbella

Yacht Hire Marbella operates the website yachthiremarbella.com, offering crewed day charters and longer charters out of Marbella, Spain. The site lists 96 yachts across superyacht, yacht, sport-yacht, day-boat and catamaran categories, with day rates starting at €1,700.

These terms apply to every charter booked through our enquiry form, by email, by phone or by WhatsApp. By sending an enquiry or confirming a booking you accept them. For any question about a booking or about these terms, write to [email protected].

A booking does not happen automatically on the website. You send us an enquiry through the form, or contact us directly by email, phone or WhatsApp, telling us your preferred yacht, dates and number of guests.

We reply with a written quote covering the yacht, dates, price and what is included. A booking is only confirmed once we have sent you written confirmation and received the payment or deposit described below. Until that confirmation is sent, no yacht or date is reserved for you.

The day rates shown on the site are a starting point; the exact price depends on the yacht, dates, duration and number of guests, and is set out in your written quote. We do not add charges to a confirmed booking that were not stated in that quote.

Depending on the yacht and charter, the following are charged separately, exactly as stated in your quote:

• Fuel
• Marina fees
• APA (advance provisioning allowance) on larger yachts
• Catering
• Any extras you request, such as additional water toys or special requests

We set out day-rate and APA guidance plainly at the quote stage so there are no surprises once you are on the water.

For day charters, the booking is confirmed once full payment has been received. For charters of two days or more, the booking is confirmed once a deposit of 50% of the price has been received; the balance is due as agreed in your written quote.

We do not take payment through the website itself. Payment arrangements are confirmed in writing once your quote is agreed.

Under EU consumer law, the usual 14-day right of withdrawal for distance contracts does not apply to leisure services booked for a specific date or period, such as a yacht charter. This exception is set out in Article 16(l) of Directive 2011/83/EU and, in Spain, in Article 103(l) of Royal Legislative Decree 1/2007. In plain terms: once you confirm a charter for a given date, you cannot withdraw simply because you changed your mind, in the way you could with an ordinary online purchase.

Instead, we offer the following cancellation terms for any charter you need to cancel:

• More than 7 days before departure: full refund
• Between 48 hours and 7 days before departure: 50% refund
• Less than 48 hours before departure: no refund

Where a refund is due, we process it within 14 business days to the payment method you originally used. If you need to change your dates or guest numbers rather than cancel, contact us at [email protected]; we will try to accommodate the change where the yacht's availability allows it, but a change requested close to departure may be treated as a cancellation under the tiers above.

Safety comes before the schedule. If the captain or the relevant port authority considers that conditions are not safe for departure or for the planned route, you choose between a free new date or a full refund. The captain's decision on safety is final and is not open to negotiation on the day.

The same choice of a free new date or a full refund applies if a charter cannot go ahead because of a technical issue with the yacht, or because of force majeure, meaning an event beyond our reasonable control such as a port closure, an official restriction, or another extraordinary circumstance. We will tell you as early as we can once such a situation becomes clear.

The number of guests on board may never exceed the vessel's licensed capacity, as stated in your quote and booking confirmation. The crew may refuse boarding to anyone whose condition or behaviour would endanger the safety of the charter, including anyone who appears intoxicated or unfit to board.

The captain is in command of the yacht at all times and has final authority over the route, speed, anchorages, use of water toys and any change to the planned itinerary, for safety or navigational reasons. For guests who want the day itself to be the highlight, we build itineraries around swim stops, water toys and beach club calls rather than a fixed sunset loop; a charter on, for example, the Benetti Oasis 40 or the Riva 130 Bellissima can run west toward Estepona and the calmer snorkelling near Punta de la Chullera, with tender and toy setup checked against guest numbers before departure. Any such itinerary is a plan, not a guarantee, and the captain may adjust it on the day.

Once on board, you and your guests must follow the crew's instructions, particularly on safety equipment, swimming areas and use of water toys. The crew may end a charter early, without refund, if guests behave in a way that endangers safety or damages the yacht.

You are responsible for any damage to the yacht, its equipment or its tender caused by you or your guests beyond normal wear, and we may charge the reasonable cost of repair.

Personal belongings brought on board remain your responsibility at all times. We do not accept liability for items lost, left behind or damaged on board unless the loss or damage is caused by our negligence.

We organise the charter and provide the yacht and crew with reasonable skill and care. We are not liable for loss or damage caused by circumstances outside our control, including weather, sea conditions, third-party acts, or decisions the captain makes for safety reasons.

Where we are found liable for loss connected to a charter, our liability is limited to the price paid for that charter, except where Spanish law does not allow such a limit, for example in cases of death or personal injury caused by our negligence.

If something about your charter does not match what was agreed, raise it with the captain or crew on the day where possible, so it can be addressed while the yacht is still out. For anything that cannot be resolved on board, or for any complaint after the charter, write to [email protected] with your booking details and a description of the issue, and we will respond in writing.

The text, photographs, yacht listings and descriptions on yachthiremarbella.com are provided to help you choose and book a charter. You may view and share pages for your own personal use, but you may not copy, scrape or reuse the content commercially without our written permission.

You are responsible for the accuracy of the information you give us in an enquiry or booking, including guest numbers, contact details and requested dates. We may rely on that information when preparing your quote and confirmation.

These terms, and any booking made through yachthiremarbella.com, are governed by Spanish law. Any dispute that cannot be resolved directly will be subject to the jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rules that entitle you to bring proceedings in your own country of residence.

We may update these terms to reflect changes to our services or to the law. The version in force at the time you confirm a booking is the one that applies to that booking. We recommend checking this page before each new enquiry.
